Terms of Service

These Terms of Service govern your access to and use of the website for VortexAQ from 10x National Security, including vortexaq.com, and any content, materials, pages, documentation, forms, APIs, developer tools, product previews, or service features made available through it, unless a separate written agreement applies.

Acceptance of these terms

By accessing or using the website or services, you agree to these Terms of Service and any additional policies or notices referenced on the website or in the applicable service. If you access the website or services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes both you and that organization.

If you do not agree to these terms, do not access or use the website or services.

Changes to these terms

We may update these Terms of Service from time to time. When we make changes, we will update the “Last updated” date above. Your continued use of the website or services after changes are posted means you accept the updated terms.

Website and service access

The website is provided for general informational, business, recruiting, documentation, product, and communications purposes. Any product previews, APIs, hosted services, developer tools, downloads, documentation, or service features made available through the website may be changed, suspended, restricted, or discontinued at any time without notice.

You may use the website and services only if you have legal capacity to agree to these terms and are not prohibited from using them under applicable law. Access is void where prohibited.

Separate agreements

These Terms of Service do not create a license to use any VortexAQ product, platform, service, software, API, confidential information, non-public capability, customer environment, deployment environment, model provider account, or production workload beyond what VortexAQ from 10x National Security expressly makes available to you. Products, services, pilots, demonstrations, integrations, support, procurement activities, enterprise subscriptions, security commitments, data processing terms, and other business engagements may be governed by separate written agreements.

If these Terms of Service conflict with a separate written agreement signed by VortexAQ from 10x National Security, the separate agreement controls for the subject matter of that agreement.

Accounts and credentials

Some services may require an account, API key, invitation, access token, identity provider, or other credential. You are responsible for maintaining the confidentiality of credentials issued to you or your organization and for all activity conducted through them.

You agree to provide accurate account information, maintain appropriate access controls, promptly disable access for users who no longer need it, and notify us of suspected unauthorized access, credential compromise, or security incidents involving the services.

Permitted use

You may use the website and services only for lawful purposes and in accordance with these terms. You agree not to:

interfere with, disrupt, or compromise the website, services, related systems, models, APIs, or networks;
attempt to gain unauthorized access to any system, account, data, source code, model, credential, customer environment, or non-public area;
probe, scan, test, or circumvent security controls without written authorization;
use bots, scrapers, crawlers, or automated tools except as allowed by robots.txt, published API documentation, product functionality, or written permission;
introduce malware, exploit code, denial-of-service traffic, prompt-injection payloads intended to bypass security controls, or harmful content;
misrepresent your identity, affiliation, authority, or intent;
use the website or services to transmit unlawful, infringing, deceptive, abusive, harmful, or privacy-invasive material;
use the website or services to develop, benchmark, train, or improve competing products or services without written authorization;
copy, frame, mirror, modify, reverse engineer, decompile, disassemble, or create derivative works from the website or services except as permitted by law;
bypass rate limits, usage limits, access restrictions, billing controls, model restrictions, policy controls, audit controls, or product safeguards;
use the website or services in violation of export control, sanctions, procurement, national security, privacy, AI governance, or other applicable laws.

AI, model, and customer content

You are responsible for the prompts, inputs, outputs, files, retrieval context, tool calls, configurations, metadata, and other content you submit to or process through the services. You represent that you have all rights and permissions needed to submit and process that content through the services.

VortexAQ from 10x National Security may process content as needed to provide, secure, operate, support, monitor, debug, improve, and enforce the services. Additional product terms, customer agreements, data processing terms, or model provider terms may govern particular services or deployments.

You are responsible for evaluating outputs before relying on them. AI-generated outputs may be inaccurate, incomplete, offensive, unsafe, non-unique, or unsuitable for a particular purpose. You should not rely on outputs as the sole basis for decisions with legal, medical, financial, safety, employment, national security, or similarly significant effects without appropriate human review and independent validation.

No sensitive submissions through public channels

Do not submit classified information, controlled unclassified information, export-controlled technical data, proprietary information, trade secrets, source code, credentials, vulnerability details, procurement-sensitive information, regulated production data, personal information, or other confidential material through public website channels unless VortexAQ from 10x National Security has expressly authorized that method in writing.

Information submitted through public website channels may not be treated as confidential unless a separate written agreement says otherwise.

Documentation and examples

Documentation, examples, reference architectures, sample code, templates, and implementation notes are provided for informational purposes only. They may not reflect the latest product behavior, security requirements, third-party provider terms, legal requirements, or customer-specific configuration. You are responsible for validating that any implementation is appropriate for your environment and obligations.

Intellectual property

The website and services, including text, graphics, logos, images, designs, software, source materials, APIs, documentation, trademarks, service marks, and other materials, are owned by VortexAQ from 10x National Security or its licensors and are protected by intellectual property and other laws.

Except for limited viewing and use of the website and services for their intended purpose, no rights are granted to you by implication, estoppel, or otherwise. You may not use VortexAQ names, logos, trademarks, or branding without prior written permission.

Subject to any separate written agreement, you retain rights to content you submit to the services. You grant VortexAQ from 10x National Security the rights needed to host, transmit, process, display, reproduce, and use that content to provide, secure, operate, support, monitor, debug, improve, and enforce the services.

Feedback

If you provide ideas, suggestions, comments, improvements, or other feedback, you grant VortexAQ from 10x National Security a perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, and incorporate that feedback without compensation. Do not submit feedback that you consider confidential or proprietary.

Third-party services

The website and services may link to, integrate with, route requests to, or depend on third-party websites, platforms, model providers, infrastructure providers, identity providers, job boards, social media pages, or other resources. Third-party services are provided by their respective operators. We do not control and are not responsible for third-party content, policies, practices, availability, security, outputs, or performance.

Your use of third-party services may be subject to separate terms, policies, fees, and restrictions.

Privacy

Our handling of personal information is described in our Privacy Policy. By using the website or services, you acknowledge that we may collect, use, and process information as described there.

Disclaimers

The website and services are provided on an “as is” and “as available” basis unless a separate written agreement states otherwise. To the maximum extent permitted by law, VortexAQ from 10x National Security disclaims all warranties, express or implied, including warranties of accuracy, availability, reliability, merchantability, fitness for a particular purpose, title, and non-infringement.

It does not constitute technical, legal, procurement, investment, export control, security, AI governance, compliance, or professional advice, and it does not create a customer, supplier, employment, partnership, agency, or fiduciary relationship.

Limitation of liability

To the maximum extent permitted by law, our total liability for any claim related to the website, services, or these terms will not exceed one hundred U.S. dollars ($100), unless a separate written agreement states otherwise.

Indemnification

You agree to defend, indemnify, and hold harmless VortexAQ from 10x National Security and its officers, directors, employees, contractors, affiliates, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to your use of the website or services, your content, your violation of these terms, your violation of law, or your violation of third-party rights.

Suspension and termination

We may restrict, suspend, or terminate your access to the website or services at any time if we believe you have violated these terms, created risk, caused harm, used the website or services in a way that is unlawful or inconsistent with their intended purpose, or if continued access may compromise security, compliance, availability, third-party provider requirements, or legal obligations.

Export controls and sanctions

You may not access or use the website or services in violation of applicable export control, sanctions, procurement, or trade laws. You represent that you are not located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive sanctions and are not listed on any restricted party list.

Governing law

These Terms of Service are governed by the laws of the Commonwealth of Virginia and applicable United States federal law, without regard to conflict-of-law principles.

Miscellaneous

If any provision of these terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent. These terms, together with any policies or notices referenced here, are the entire agreement between you and VortexAQ from 10x National Security regarding website and service access and use, unless a separate written agreement applies.
